Terms of Service
Effective Date: May 10, 2025
1. Acceptance of Terms
By accessing or using our site and services—custom whiteboard animation, scriptwriting, voice-over production, video delivery—you agree to these Terms. If you disagree, please do not use our services.
2. Scope of Services
Core offerings: concept ideation, scriptwriting, professional voice-overs, hand-drawn animation, background music, unlimited revisions.
Custom add-ons (e.g., multilingual voice-overs, bespoke illustration styles, rush turnaround) can be arranged and invoiced separately.
3. Ordering, Invoicing & Payment
- Pricing: All fees in U.S. Dollars (USD) unless stated otherwise.
- Payment Methods: Stripe, PayPal, Verifone, or other agreed processors.
- Payment Terms:
- Milestone Model: Deposits, interim payments, and final balance as per invoice.
- Payment-After-Delivery: At our discretion; ownership transfers upon full payment.
4. Delivery & Revision Policy
- Timeline: Milestones outlined in proposal; changes require written agreement.
- Revisions: Each package includes a set number of complimentary revisions; submit requests together.
5. Intellectual Property & Usage Rights
- Ownership Transfer: Full rights assign to you upon receipt of full payment.
- Retained Rights: Work remains proprietary until payment clears.
- Portfolio Use: We may showcase your project in our marketing unless you request otherwise.
6. Cancellations & Refunds
- Cancellation Window: Cancel at no cost before production (scripting/storyboarding/voice/animation).
- Refund Eligibility: After production begins, fees are non-refundable except as outlined in our Refund Policy.
7. Limitation of Liability
Toon Theory is not liable for indirect, incidental, special, or consequential damages. Aggregate liability is capped at fees paid in the six months prior to the event.
8. Indemnification
You agree to indemnify Toon Theory and its affiliates from losses, claims, damages, or expenses arising from:
- Your breach of these Terms.
- Unauthorized use of deliverables.
- Claims that your materials infringe third-party rights.
9. Governing Law & Dispute Resolution
These Terms are governed by U.S. law. Disputes shall be brought exclusively in the federal or state courts of your project’s jurisdiction.

We may update these Terms at any time. Material changes will be emailed or posted on our site. Continued use constitutes acceptance.

Refund Policy

1. General Refund Guidelines
- Pre-Production Cancellations: Full refund if you cancel before production begins.
- Post-Production Commencement: All sales final once work has commenced, except as in Section 2.
2. Refund Eligibility & Exclusions
Eligible for Refund:
- Failure by Toon Theory to deliver core services as agreed.
- Unilateral missed deadlines without rescheduling agreement.
- Persistent critical defects after all revision rounds.
Not Eligible for Refund:
- Delays due to your failure to provide feedback or materials.
- Change of mind or dissatisfaction when work matches agreed references.
- Minor stylistic or subjective aesthetic preferences.
3. How to Request a Refund

We acknowledge within 2 business days, decide within 5 days, and process approved refunds within 7–14 days.
4. Chargebacks & Dispute Resolution
Please contact us before initiating chargebacks. Unauthorized chargebacks may suspend or terminate services and affect future approvals.
5. Changes to This Refund Policy
We may revise this policy at any time. Updated versions take effect upon posting with a new “Effective Date.” Continued use constitutes acceptance.
